4. Information relating to recording, processing and use of your data

We record specific data as soon as you start using FarmBookpro. In the following, we have listed the purpose behind recording each piece of information and exactly which personal data we actually record.

4.1 Information that is automatically recorded

When you use FarmBookpro, we record and save specific data automatically. This information includes: the technical and connection-related data such as the IP address and MAC address, which we require in order to transmit the content you have queried or the content that we have to provide to you (e.g. texts, images and production information, as well as files made available to download, etc.), requirement content, access-status / http-status code, amount of data transmitted, the website from which the query was received, browser, operating system and its interface, language and version of the browser software, as well as date and time that the query was made.

We use the aforementioned information, (1) in order to make the service and the associated functions available to you; (2) to improve the functions and performance characteristics of FarmBookpro and (3) to prevent and remove misuse, as well as malfunctions (including troubleshooting). You can find further information on the techniques used and their purpose with respect to data processing under point number 5.

The processing and use of data is done so on the basis of statutory legislation. In accordance with this legislation, the data processing is justified by the fact: (1) that the processing is required for fulfilling the contract which allows FarmBookpro to be used, or (2) Big Dutchman has a justified interest in guaranteeing the functionality and the faultless operation of FarmBookpro and to be able to offer a service that is adapted to the user.

4.2 Creating a user account (registration) and login

When you register with FarmBookpro, we save the e-mail address you provide and the password that you choose. In addition to your e-mail address and password, you can also add further information to your user account, such as, for example, first name and last name, the name and address of your organisation and the Livestock Movement Licence number.

Any further information provided by the user is done so on a voluntary basis and is not absolutely necessary in order to register with FarmBookpro. All information provided can be viewed or changed within the user account under ‘My Profile’ or ‘Farms’. The data provided by the user are saved in the respective user account. It is absolutely essential that you register in order to be able to use FarmBookpro, meaning among other things, receiving technical access to the server and preventing the unauthorised accessing by third parties.

Your registration is only then complete when you have activated your user account by entering the confirmation code that you have been provided for the purpose of completing the registration.

If you would like to create a user account or login to the one you have already created, we use your access data (e-mail address and password) in order to grant you access to and administer your user account. We use the access data for authentication purposes when logging-in and to process requests for the password to be reset.

We use and process the information you provided when registering or logging in, in order to (1) verify your authorisation and administration of the user account; (2) to assert the FarmBookpro terms of use, as well as all rights and obligations associated with this and (3) establish contact with you in order to be able to send you technical information, updates, security notifications or messages that have a meaning for the administration of the user account.

The processing and use of data is done so on the basis of statutory legislation. Afterwards, the data processing is justified by the fact that: (1) the processing is required in order to fulfil the requirements of the contract governing the use of FarmBookpro, or (2) Big Dutchman has a justified interest in guaranteeing the functionality and the fault-free operation of FarmBookpro.

4.3 Using FarmBookpro

FarmBookpro allows the user to enter, administer and process diverse types of information, tasks and activities that are related to their organisation. The recording of the respective data is user-related and a time stamp is applied to each respective recorded piece of data. The data recorded in this manner is transferred to the server and is saved there for the duration of the usage relationship. A unique ID code is also furthermore assigned to the organisation. Each piece of information that was recorded with the help of FarmBookpro for the respective user, in particular, includes the data relating to the organisation (such as address, region, country, etc.); data relating to individual procedures (in the following “production data”); key figures related to feed deliveries or silos and activities (such as recording of guests visiting the facility, the delivery / pick-up of animals or feed, vaccinations and veterinary treatments and pest control). When the user provides information which could relate to a natural person in doing so, such as name and contact details (in particular postal addresses, telephone numbers and e-mail addresses) of farmers, guests, suppliers, animal traders, breeders, slaughterhouses, veterinarians or other organisation employees who use FarmBookpro, FarmBookpro will also process these data as part of providing the service.

The website makes it possible for you to add photos of documents, like delivery notes and invoices, as well as further image recordings to your already recorded data for documentation purposes. In this case, the personal-related data that we record, process and use from the documentation and other image recordings made available to us, is something that you primarily dictate by the documents and files that you choose.

The processing of the data takes place on the basis of the statutory legislation. As a result of this, the data processing is justified because the processing is required in order to fulfil the FarmBookpro licence agreement.

4.4 Maintenance of specific data in the customer database

Big Dutchman maintains personal data in a customer database that are relevant for the justifying, the content-related structuring or the amending of the FarmBookpro usage relationship (in the following “inventory data”). These inventory data, in particular, include e-mail addresses, first names and last names, and possibly also the customer’s address.

The processing of these data is carried out on the basis of the statutory legislation. As a result of this, the data processing is justified because: (1) processing is required in order to fulfil the FarmBookpro licence agreement or (2) Big Dutchman has a justified interest in processing the data for the purpose of administering the customer relationship.

 

5. Fading in advertisements and advertising banners

On the website, we would like to address you with targeted and interest-related advertising for our own products and services. It is for this reason that we place advertisements and advertising banners on the website. In order to align the advertisements to your interests, we may create pseudonymised user profiles based on your preferences and on what your interests are focussed. The fading in of advertisements and advertising banners takes place on the basis of the statutory legislation. As a result of this, the data processing is justified because Big Dutchman has a justified interest in learning what the users’ preferences are in order to be better able to align the offers to the respective customers and so offer goods and services that are better able to meet the needs and wishes of the customer.

You can revoke the right to create user profiles and process your data for profiling purposes that you have provided to Big Dutchman at any time.

 

6. Sending advertising material

We use the data provided by the user in order to send by post advertising and news on improved service offers and other happenings to the organisations’ address as provided by the user. The sending of advertising material is carried out on the basis of the statutory legislation. As a result of this, the data processing is justified because Big Dutchman has a justified interest in learning what the users’ preferences are in order to be better able to align the offers to the respective customers and so offer goods and services that are better able to meet the needs and wishes of the customer.

You can revoke the right that you have provided to Big Dutchman to send advertising material to the address you indicated at any time.

In addition to this, we may also use the e-mail address you provided to send you advertising material, to the extent that we are legally entitled to do this; in particular, because you have agreed to receive such advertising materials (e.g. by subscribing to our newsletter) or because we have received your e-mail address in connection with the sale of goods or services and because we advertise similar products and services of our own.

The sending of advertising material is carried out on the basis of your agreement and the statutory legislation. In the latter case, the accompanying data processing is justified because Big Dutchman has a justified interest in learning what the customers’ preferences are in order to be better able to align the offers to the respective customers and so offer our own comparable goods and services that are better able to meet the needs and wishes of the customer.

You can revoke any possible agreements to receive e-mail-based advertising at any time and effective from that point in time onward. You are furthermore legally entitled to revoke at any time the agreement you provided to Big Dutchman that your e-mail address may be used to send advertising, without any costs apart from the transfer costs according to the base rates.

 

7. Analytics and advertising

7.1 Google Analytics

This website uses Google Analytics, a web analytics service operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

7.6 Demographic data collection by Google Analytics

This website uses Google Analytics' demographic features. This allows reports to be generated containing statements about the age, gender, and interests of site visitors. This data comes from interest-based advertising from Google and third-party visitor data. This collected data cannot be attributed to any specific individual person. 7.7 Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on our websites. This service is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google").

reCAPTCHA is used to check whether the data entered on our website (such as in a contact form) has been entered by a human or by an automated program. To do this, reCAPTCHA analyses the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. 10. Passing on of data

Passing on of your personal data without your prior express agreement will only take place, in addition to the cases explicitly outlined in this data-protection declaration, in the following cases:

  • Big Dutchman is a company based in Germany, which does business on an international level and is part of the Big Dutchman group. Certain personal data, such as data provided when a user is registering, may be shared within the Big Dutchman group for internal administration purposes, which includes joint customer service within the framework of what is required.
  • Only if it is necessary in order to clarify an illegal use or misuse of FarmBookpro or if it is required in order to pursue legal proceedings, will personal data be shared with the public prosecution authorities, as well as the aggrieved third party, if necessary. This only happens when evidence exists for such illegal use and abusive behaviour. Sharing and passing on is also allowed when this is required in order to assert the terms of use or other agreements. We are furthermore obligated to provide certain public bodies with information should they request this of us. These are public prosecution authorities, authorities that pursue and collect fines handed down for misdemeanour offences and the tax office.
  • We are occasionally reliant on contractually associated companies of the Big Dutchman group or third-party companies and external service providers when it comes to, for example, hosting FarmBookpro and the data that is recorded while doing so. In such cases, information is passed on to these companies or individual persons in order to make further processing possible. We carefully select these external service providers and regularly conduct checks in order to ensure that your privacy is maintained and the data may be used exclusively bound by instructions and the purposes prescribed by us. In the course of continuing to develop our business, it can happen that the structure of our company will change by altering the legal form, or by founding, purchasing or selling subsidiaries, parts or components of companies. In the case of such transactions, the customer information may be passed on at the same time that the parts to be transferred are passed on. Every time personal data are passed on to third parties in the aforementioned scope, we ensure that this is done in accordance with this data protection declaration and the applicable data protection laws.

Any passing on of personal data takes place on the basis of the statutory legislation. In accordance with this legislation, the data processing is justified by the fact: (1) that the processing is required for fulfilling the contract which allows FarmBookpro to be used, or (2) Big Dutchman has a justified interest in passing on the data for administrative purposes or the processing that is required in order to meet the statutory obligations to which Big Dutchman is subject. Due to the abovementioned passing-on of data, it can happen that these data are processed in third countries, countries in which the legislation of the country in which the user has their habitual place of residence and in which they use the app does not apply and which are not part of the European Economic Area (in the following “EEA”). Any passing on of data to third countries is done so in accordance and compliance with the applicable data protection legislation. If the European Commission does not determine that a suitable level of data protection exists in the third country, Big Dutchman makes provisions to provide suitable guarantees that your data will be adequately protected. 11. Contact form 

Should you send us questions via the contact form, we will collect the data entered in the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission.

We will therefore process any data you enter into the contact form only with your consent per Art. 6 (1)(a) GDPR. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

We will retain the data you provide in the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e. g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.

 

12. Detecting and prosecuting misuse

We usually retain information for detecting and prosecuting misuse, in particular, your IP address, for a maximum of 7 days when they are no longer required for a criminal prosecution. 13. Deleting the data

We generally delete or anonymise your personal data as soon as they are no longer required for the purposes that we recorded and used them for and as outlined in the preceding contractual clauses. Specific instructions contained in this data protection declaration relating to archiving and deleting personal data remain unaffected.

 

14. Your rights as the aggrieved party

You have the right at all times to receive information on the data that is saved relating to you. When you present the respective legal prerequisites, you may also be entitled to the right to have the personal data relating to you that we have saved corrected, as well as deleted, or the limitation of the processing of your personal data, or a right of revocation with respect to the processing, as well as, possibly, the right to data transferability.
